Terms of Service

By accessing or using Avatarli (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service.

These Terms apply to all users, including visitors, registered users, and administrators. They should be read together with our Privacy Policy and Acceptable Use Policy, both of which form part of this agreement.

Avatarli is an AI-powered presenter video studio. Users write a script, select an AI presenter from the Avatarli catalog, choose a video model and duration, and receive a downloadable MP4 video. Video generation is performed using third-party AI providers on behalf of Avatarli.

Avatarli does not provide legal, medical, financial, advertising, or other professional services. Nothing in the Service constitutes professional advice of any kind.

You must be at least 13 years old to use Avatarli. If you are under the age of legal majority in your jurisdiction, you may use Avatarli only with parental or guardian consent. By creating an account, you represent and warrant that you meet these requirements and that all information you provide is accurate.

You are responsible for maintaining the security and confidentiality of your account credentials. You are responsible for all activity that occurs under your account. If you become aware of any unauthorized access to your account, notify us immediately at support@avatarli.com.

You may not share your account with others or allow others to access the Service using your credentials.

Credit System

Avatarli uses a credit-based system. Credits are purchased in one-time packs through our payment processor (Stripe). Credits are used to pay for AI video generation. The credit cost of each generation is based on the selected model, duration, and settings.

Credit Costs and Deduction

The expected credit cost of each generation is displayed before you confirm the request. Credits are reserved and deducted when you submit a generation request. Actual costs are determined server-side and may not always match estimates displayed on third-party screens or cached pages.

Pricing Changes

Credit pack prices, credit costs per model or duration, available models, and features of the Service may change at any time. We will endeavour to communicate material pricing changes in advance.

Your Ownership

You retain ownership of the original content you submit to Avatarli, including scripts, prompts, creative instructions, uploaded images, scene descriptions, and other materials (“Submitted Content”).

License to Process

By submitting content to Avatarli, you grant Avatarli a limited, non-exclusive, worldwide, royalty-free license to use, process, transmit, and store your Submitted Content as necessary to provide the Service. This includes sending your Submitted Content to third-party AI providers for video generation.

Your Representations

By submitting content, you represent and warrant that:

• You own or have obtained all necessary rights, licenses, consents, and permissions to submit the content and to use it as described in these Terms.
• Your Submitted Content does not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
• Your Submitted Content complies with these Terms and our Acceptable Use Policy.
• Any persons depicted in, referenced in, or identifiable from your Submitted Content have given their explicit, informed consent to appear in an AI-generated video for your intended purpose.

You must not use Avatarli to create, promote, distribute, or enable prohibited content. The following is a non-exhaustive summary of key prohibitions. For the full list, see our Acceptable Use Policy.

• Using, referencing, or recreating the face, voice, name, likeness, identity, or personal attributes of any real person without their explicit written consent.
• Impersonating celebrities, public figures, politicians, private individuals, brands, companies, or organizations.
• Creating false endorsements, fake testimonials, deceptive advertising, misleading representations, or fabricated official communications.
• Using generated videos for fraud, scams, phishing, social engineering, identity deception, or any unlawful scheme.
• Infringing copyright, trademark, publicity rights, privacy rights, or other third-party intellectual property rights.
• Creating sexual content, content involving minors in harmful contexts, or content that incites hate, violence, or abuse.
• Using the Service for any purpose that is illegal under applicable law.

AI video generation is an emerging technology with significant limitations. By using Avatarli, you acknowledge and accept that:

• AI-generated video output may be imperfect, inconsistent, inaccurate, incomplete, or materially different from what you expected or described.
• Avatarli does not guarantee exact face, body, or character consistency between generation attempts or between clips within a single generation.
• Avatarli does not guarantee accurate lip-sync between the video and your script, or between different clips.
• Avatarli does not guarantee any specific voice tone, pronunciation, accent, intonation, language quality, or rendering of Hebrew or other non-Latin scripts.
• Avatarli does not guarantee specific camera angles, lighting conditions, scene composition, background, or visual style.
• Generation time, availability, output quality, model performance, and features may vary or be unavailable at any time without notice.
• AI-generated output may contain artifacts, errors, hallucinations, or content that does not accurately reflect your script.
• Generated videos are not suitable for regulated professional purposes (healthcare, legal, financial, regulatory filings, etc.) without your independent professional verification and compliance review.

You assume full responsibility for reviewing, verifying, and approving any generated video before using it for any purpose, including commercial distribution.

Avatarli uses third-party AI providers to generate video and image outputs. These providers include but are not limited to fal.ai, Google Gemini, OpenRouter, Anthropic, and others as described in our Privacy Policy.

To generate your video, your submitted scripts, prompts, images, scene descriptions, avatar selections, and related data are transmitted to these providers. By using Avatarli, you consent to this processing.

Avatarli is not responsible for the independent data practices, policies, terms, or output of third-party AI providers. Avatarli cannot guarantee the security, accuracy, or behavior of third-party AI systems.

Third-party AI provider availability, API behavior, and output quality may change at any time and are outside Avatarli’s direct control.

Avatarli’s Rights

The Avatarli platform, software, visual design, brand, and AI presenter characters are the property of Avatarli and its licensors. All rights not expressly granted to you are reserved. You may not copy, reverse engineer, scrape, extract, reproduce, or create derivative works from Avatarli’s technology, presenter assets, brand elements, or system logic.

Generated Output

Subject to your full compliance with these Terms and our Acceptable Use Policy, and subject to payment of applicable credits, you may use generated videos for personal or commercial purposes. This license is conditional on your compliance with these Terms and applicable law. Avatarli does not warrant that AI-generated outputs are free from third-party intellectual property claims.

AI-generated outputs may be subject to evolving legal interpretations regarding ownership, copyright, and other rights in various jurisdictions. You are responsible for understanding and complying with applicable law in your jurisdiction.

Avatarli may, at its sole discretion and without prior notice:

• Decline to generate a specific content request.
• Remove or disable access to generated content that violates these Terms or our Acceptable Use Policy.
• Suspend or permanently terminate your account and access to the Service.
• Restrict access to specific features or models.
• Retain records of generation activity for abuse investigation, legal compliance, and platform integrity purposes.
• Cooperate with law enforcement, courts, or regulatory authorities where required by applicable law.

Avatarli is not responsible for the uses to which you put generated videos after download. Generating a video does not constitute Avatarli’s endorsement, review, or approval of the content of that video.

Your use of Avatarli is subject to our Privacy Policy, which describes how we collect, use, and share information about you. By using the Service, you agree to the collection and use of information as described in the Privacy Policy.

You agree to defend, indemnify, and hold harmless Avatarli and its officers, directors, employees, contractors, licensors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Service.
• Your Submitted Content, including any claims that it infringes third-party rights.
• Your violation of these Terms.
• Your violation of any applicable law, regulation, or third-party right.
• The use or distribution of any video generated using your account.

To the maximum extent permitted by applicable law, Avatarli’s total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid Avatarli in the twelve months immediately preceding the event giving rise to the claim, or (b) USD $50.

To the maximum extent permitted by applicable law, in no event shall Avatarli be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business, even if Avatarli was advised of the possibility of such damages, and regardless of the legal theory (contract, tort, strict liability, or otherwise).

Some jurisdictions do not allow the exclusion or limitation of certain types of liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.

Avatarli does not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Avatarli does not warrant that AI-generated outputs will be accurate, complete, appropriate for your purpose, or free from third-party intellectual property claims.

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in Israel.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

We may update these Terms from time to time. When we make material changes, we will notify you by posting an updated version with a new “Last updated” date, and, where appropriate, by sending you an email notification or displaying an in-app notice.

Your continued use of Avatarli after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
